Blogging Finale 10/16

Due to unforeseen circumstances, I had to abruptly halt the blog party. The final posting will come tomorrow...along with the winner of the Paint It Purple Gift Basket! That means I'll be accepting entries until then! Email author@diamondcartelnovels.com with your name, age, and contact information (email or phone). Thanks to those that attended, and prepare for the grand finale!

My Story: Part 1

My experience with violence and abusive relationships was more than physical. I've had to endure more than one level of abuse, yet with the help of God I got out alive. I'll speak directly about my experiences in the next posting, but for now here is an article I wrote about my situation that was published in Flaimahmy Magazine.

DV: A Minor Charge With Major Punishment

In the court of law, domestic violence is considered a misdemeanor. While it is the equivalent of assault and battery (actually, it is assault and battery amongst couples), there is no felony conviction. That doesn't mean the assaulter gets off scott free! They still are held accountable for their actions in ways that can affect their standard of living...and their life.

When a person pleads guilty/is found guilty of domestic violence several punishments may be issued. Depending on their criminal history, even if they don't have one, they can still do jail time and have heavy fines imposed upon them. The DV charges go on their criminal record and can affect their ability to carry firearms; even your employment may be affected depending on the requirements of your job.

In the case of divorce/separation, a DV charge can affect your ability to see your children, gain custody, or set foot on your residence/property. If there's a history of DV on record, it makes the situation worse. The person assaulted may also be granted a restraining order which can cover them and their children if any are involved.

Being a survivor of domestic violence, I don't think this punishment is enough. When I filed charges, all my assaulter got was 24 hours in jail (only because he had to wait to sign out on his own recognizance), and probation for a year. That was it! Personally, I think it should be considered a felony; either second or third degree. Something more serious than a misdemeanor! I guess in due time there will be changes, but only if we stand together and say enough is enough!

What is domestic violence?

Domestic violence is summed up as physical altercations between two people that are in a relationship. Typically, but not always, the assaulter is the male and the person being assaulted is the female. Statistically the following has been found:

  • 1 in 4 women will be involved in a DV situation
  • Approx. 1.3 million women are assaulted by their partner yearly
  • 85% of all DV cases involve women
(*statistics found at http://www.ncadv.org/)

Numbers don't lie...and with statistics like this it baffles me to wonder why more isn't being done about this heinous crime. What is even more disturbing is that even MORE cases go UNREPORTED!

Many women refuse to report DV incidents for various reasons:
  • They don't want to make their spouse/significant (or in my opinion not-so-significant) other upset
  • They don't feel protected by the police
  • Children are involved
  • They don't want to end up sad and lonely
  • They feel it's their fault
All of these reasons can apply, yet none of them are valid. No one, and I mean absolutely NO ONE, has the right to lay their hands on you! PERIOD! DV is a punishable crime, and although it's considered a misdemeanor (which I'll discuss more in the next blog) it is a punishable offense.

Regardless of any excuse, DV is not okay! If you or someone you know is stuck in a domestic violence situation please seek help IMMEDIATELY! Tomorrow may be too late!
